Council Tax Is A Separate Claim

Council Tax Reduction is means-tested under the local scheme. Discounts, exemptions and disregards depend on who lives in the property and their circumstances.

Severe Mental Impairment has a specific legal test. It normally requires medical certification and entitlement to a qualifying benefit. A diagnosis alone is not enough, and the result depends on the other adults in the household.

Does living in supported living automatically mean claiming Housing Benefit?
No. The housing route depends on the accommodation and support arrangement. Some supported or sheltered accommodation providing care, support or supervision falls within Housing Benefit rules, while other tenants claim the Universal Credit housing element. The council should decide the category from the actual facts.
Can someone claim Universal Credit and Housing Benefit at the same time?
In certain supported, sheltered or temporary accommodation, a working-age person may receive Universal Credit for living costs while Housing Benefit meets eligible housing costs. This is an exception to the general Universal Credit housing route and requires the council to accept the accommodation category.
Does Housing Benefit pay for care and support?
No. Housing Benefit is for eligible housing costs. Care and support require a separate funding route such as local-authority social care, NHS funding, Section 117, a direct payment or private payment. Some housing-related service charges may qualify, but personal support should not be presented as rent.
Can PIP be paid to someone who works or has savings?
Yes. PIP is not means-tested and can be paid while working or holding savings, provided the person meets the age, residence, duration and functional-impact conditions. Entitlement depends on how the condition affects specified activities, not diagnosis alone.
Can Attendance Allowance be paid in supported living?
Potentially, yes, where the person meets the eligibility conditions. Supported living is not automatically treated as a care home. Payment can be affected by certain publicly funded care-home or hospital stays, so report changes and obtain individual advice.
What is disability-related expenditure?
It is reasonable additional expenditure related to disability that should be considered where disability benefits are taken into account in a non-residential social-care charging assessment. The person should explain the need, amount and frequency and provide available evidence.
Does a DWP appointee control all of the person’s money?
No. DWP appointeeship concerns benefit claims and benefit money. It does not automatically authorise control of other bank funds, property, contracts or care decisions. Wider financial authority may require a registered LPA or Court of Protection order.
Can support staff keep a person’s bank card and PIN?
This should never be treated as routine. Any assistance must follow consent, capacity, organisational policy, risk assessment and safeguarding controls. Sharing a PIN can breach bank terms and expose the person and staff to risk. Safer alternatives should be considered.
What happens to benefits during a hospital admission?
The effect varies by benefit, length and type of stay, funding position and previous circumstances. Report the admission and discharge promptly to each relevant office, check rent liability and keep evidence of dates. Do not assume all benefits stop immediately.
What if housing support does not cover the full rent?
Check the eligible-rent calculation, accommodation classification, service-charge treatment, bedroom rules and deductions. Challenge factual errors and ask the council about any applicable discretionary assistance. Agree an arrears-prevention plan while the decision is reviewed.
